The gradual decrease of the physical and mental capacities of the elders, place them in the condition of vulnerable group, which need of special rights for a distinctive treatment before the legal and social processes, and to contribute this way to a better quality of life.

In the Cuban Constitution the discrimination is proscribed by race, color of the skin, national origin and religious beliefs, and it is established that all citizens enjoy of equal duties and rights, such as free education and medical care, work and housing, among others.

But as considers in her thesis of mastery Erlisnay Rivera, specialist of the Provincial Board of Justice of Camagüey, although this institutes the elders' protection without resources or cover, it lacks a modern legislative frame that recognizes in a specific way the rights of all the elders.

This researcher proposes a modification to the VIIth Chapter "Rights, Duties and Fundamental Guarantees" by means of a section that could be named "Derechos De Las Personas Adultas Mayores", and the implementation of a specific law for the institutions regulation to help their protection.

It also urges to establish the duty of the State for the development of programs and politics destined to encourage their personal autonomy, to diminish their dependency and to obtain their full social integration, in addition to encouraging the achievement of recreational and spiritual activities, and the performance of a work according to their capacities.

These are some among the so many ideas arisen to the heat of the high indexes of aging of Cuba, a country with a life expectancy average of 78.5 years, fact that deserves definitely a major support of the Great Letter of the Republic for the care of the elders.

It is true that the grandparents have regulations that protect them from generic form, reflected specially in social work questions, but from the juridical point of view a big dispersion exists, which obstructs an integral attention that respond to their elementary demands.
